You are responsible for what you post or upload: By sending us Submissions and/or posting Contributions through any part of the Services or making Contributions accessible through the Services by linking your account through the Services to any of your social networking accounts, you:

  • confirm that you have read and agree with our ‘PROHIBITED ACTIVITIES‘ and will not post, send, publish, upload, or transmit through the Services any Submission nor post any Contribution that is illegal, harassing, hateful, harmful, defamatory, obscene, bullying, abusive, discriminatory, threatening to any person or group, sexually explicit, false, inaccurate, deceitful, or misleading;

We may remove or edit your Content: Although we have no obligation to monitor any Contributions, we shall have the right to remove or edit any Contributions at any time without notice if in our reasonable opinion we consider such Contributions harmful or in breach of these Legal Terms. If we remove or edit any such Contributions, we may also suspend or disable your account and report you to the authorities.

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Legal Terms; (4) you are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the Services; (5) you will not access the Services through automated or non-human means, whether through a bot, script or otherwise; (6) you will not use the Services for any illegal or unauthorised purpose; and (7) your use of the Services will not violate any applicable law or regulation.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate. Additionally, the following provisions apply to our Goods:

  • Goods Representation: The images of the Goods on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device’s display of the colours accurately reflects the colour of the Goods. Your product may vary slightly from those images. Specifically, for natural living products such as wood, variations in grain pattern and colour variance are natural characteristics and these cannot be accepted as a reason for exchange or rejection.
  • Goods Examination: Prior to commencing the installation or making any adjustments to the flooring, please examine them for any faults. By fitting the flooring or making alterations in any way, we shall deem you to have accepted the goods as supplied. We shall not be held responsible for any incidental work or expense arising out of or because of any defect in our product, or bad workmanship applied to our goods.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

6. PURCHASES AND PAYMENT

You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorise us to charge your chosen payment provider for any such amounts upon placing your order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

We reserve the right to refuse any order placed through the Services. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers, or distributors.

Clearpay

Together with Clearpay Finance Limited, we offer the option to pay for your purchases in four interest-free instalments, due every two weeks. This service allows you to receive your goods upfront while spreading the cost over a short period without incurring interest. Clearpay is available to customers over the age of 18 with a UK bank account and a UK residential address. 8. DELIVERY POLICY

Introduction

This Delivery Policy forms part of the Terms and Conditions for purchases made through Floor Warehouse, an online flooring retailer. It outlines the terms under which we process, ship, and deliver orders. By placing an order with us, you agree to the terms set forth in this policy.

Order Processing: Orders are processed in the sequence they are received. Our aim is to prepare your order for shipment as swiftly as possible.

Delivery Time: The standard delivery timeframe is between 2 to 5 working days from the order date. Please note that during holidays and peak shipping seasons, delivery times may be extended due to increased volume.

Shipping and Delivery Services

Kerbside Delivery: Our standard delivery method is kerbside, which means that items will be delivered to the nearest kerbside location to the delivery address. This applies to both standard and palletised goods.

Freight Carriers: We partner with various freight carriers, and the type of delivery service may vary depending on the carrier’s policies. Typically, carriers consider inside delivery as an additional service, potentially incurring extra charges.

Special Delivery Considerations

Heavy Goods: Given the size and weight of our products, customers should arrange for additional help to unload goods upon delivery.

Access and Restrictions: Please inform us of any access restrictions at the delivery address at the time of your order. This includes narrow roads, low bridges, or the need for delivery to a private road. Failure to inform us may result in delivery delays or the need for alternative delivery arrangements, potentially incurring additional charges.

Address and Contact Information

Accuracy of Information: It is crucial that you provide an accurate delivery address and contact phone number during the checkout process. This ensures that carriers can deliver your order efficiently and contact you if necessary.

Changes to Delivery Address: If you need to ship your order to an address different from the billing address, you must specify this during the checkout process. Failure to Deliver: If we are unable to deliver your order due to your absence, refusal of the delivery, lack of adequate help, or last-minute cancellations or changes, you will be responsible for any additional costs incurred for the goods to be returned.

Cancellations, Returns, and Refunds

Cancellation Before Shipment: You may cancel your order for a full refund prior to its shipment.

Returns and Refunds After Shipment: If an order has been shipped and is in transit, you are responsible for the return shipping costs should you decide to cancel. Under the Distance Selling Regulations, you have the right to cancel the purchase within 14 working days of receiving your order, provided that the goods are returned in their original condition at your expense.

Distance Selling Regulations: These regulations allow you to cancel your order within the specified period for any reason for a full refund. However, you must cover the cost of returning the item to Floor Warehouse. The item must be unused and in its original packaging.

Liability and Damages

Damages in Transit: If the external packaging of your order is damaged upon arrival, it is essential to check the contents immediately and note any damages on the carrier’s delivery note. If you suspect the goods are damaged, you must sign for them as ‘Damaged’ and report any issues to us within 48 hours of delivery.

Limitation of Liability: While we strive to ensure timely and secure delivery of your order, we cannot accept liability for any loss or damage resulting from delivery delays or failures caused by circumstances beyond our control, including but not limited to access restrictions at the delivery location, adverse weather conditions, or carrier issues.

9. RETURN POLICY

Introduction

This Returns Policy is an integral part of the Terms and Conditions for purchases made through Floor Warehouse. It outlines the procedures and conditions under which returns are accepted and processed. By purchasing from us, you agree to adhere to the terms set forth in this policy.

Contacting Us

Notification of Return: Should you wish to return an item, it is essential to contact us at the earliest opportunity. Please email us at help@floorwarehouse.co.uk to initiate the return process.

Conditions for Return

Item Condition: Returned items must be complete, unused, and in “as new” condition. If packaging is opened to examine the product, please ensure it is done carefully to avoid damage. Items not adequately packaged or damaged will not be accepted for return.

Care of Goods: Reasonable care must be taken to ensure the goods are not damaged before returning. Charges will apply for any damage or deterioration due to inadequate care.

Right to Reject: You have a 14-day right to reject starting from the day the goods are delivered, as specified in the UK The Consumer Contracts Regulations 2013 and The Consumer Rights Act 2015. This does not apply to bespoke goods. Notification of intent to return within this period is requested, followed by an additional 14 days to return the goods.

Return Shipping: The responsibility and cost of returning the goods lie with you. We recommend insuring the goods against damage in transit as liability for any damage remains with you until the return is complete.

Exclusions and Charges

Bespoke Goods: Custom-made or bespoke items, specials, clearance lines, or non-stock items cannot be returned.

Restocking Charge: A 20% restocking fee applies to returned products.

Shipping Costs: Return shipping costs are non-refundable. Any refund issued will have the return shipping costs deducted.

Product Pairs: Items sold in pairs must be returned as such. We cannot accept returns of odd quantities.

Processing Returns

Inspection: Upon receipt and inspection of the returned goods, we will notify you via email regarding the approval or rejection of your refund.

Payment Refund: Once a return is approved, payment will be refunded within 14 days to its original payment source.

Manufacturing Faults: If a product arrives with a manufacturing fault, please contact us at help@floorwarehouse.co.uk. Include images of the fault for assessment. We will address the issue promptly in line with our terms.

Damaged Deliveries

Reporting Damage: Any deliveries received with damaged products or missing items must be signed for accordingly. The term “unchecked” will not be accepted for claim as specified in the Delivery Policy.

Documentation: We request photos of the damaged or missing items to support any claims.

Order Cancellation

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false  or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the  Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. Contributions may be viewable by other users of the Services and through third-party websites. As such, any Contributions you transmit may be treated as non-confidential and non-proprietary. When you create or make available any Contributions, you thereby represent and warrant that:

  • Your Contributions do not violate any applicable law, regulation, or rule.
  • Your Contributions do not violate the privacy or publicity rights of any third party.
  • Your Contributions do not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors.
  • Your Contributions do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap.
  • Your Contributions do not otherwise violate, or link to material that violates, any provision of these Legal Terms, or any applicable law or regulation.

Any use of the Services in violation of the foregoing violates these Legal Terms and may result in, among other things, termination or suspension of your rights to use the Services.

By posting your Contributions to any part of the Services, you automatically grant, and you represent and warrant that you have the right to grant, to us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and licence to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such Contributions (including, without limitation, your image and voice) for any purpose, commercial, advertising, or otherwise, and to prepare derivative works of, or incorporate into other works, such Contributions, and grant and authorise sublicences of the foregoing. This licence will apply to any form, media, or technology now known or hereafter developed, and includes our use of your name, company name, and franchise name, as applicable, and any of the trademarks, service marks, trade names, logos, and personal and commercial images you provide. You waive all moral rights in your Contributions, and you warrant that moral rights have not otherwise been asserted in your Contributions.

We do not assert any ownership over your Contributions. You retain full ownership of all of your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions. We are not liable for any statements or representations in your Contributions provided by you in any area on the Services. You are solely responsible for your Contributions to the Services and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Contributions.

20. DISPUTE RESOLUTION

Informal Negotiations

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Legal Terms (each a ‘Dispute’ and collectively, the ‘Disputes’) brought by either you or us (individually, a ‘Party’ and collectively, the ‘Parties’), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least 30 days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.

Restrictions

The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilise class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

Exceptions to Informal Negotiations and Arbitration

The Parties agree that the following Disputes are not subject to the above provisions concerning informal negotiations binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorised use; and (c) any claim for injunctive relief. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.
